Saturday, February 7, 2009 Instructor's Forum Presents:
Tough Academic Decisions and Legal Issues Involving Students:

Educators at many levels are charged with the responsibility for the evaluation of student performance in clinical and professional training site experiences.  This program is designed to give participants a better understanding of how the courts view such decisions in clinical and professional fieldwork experience programs.  Using a case study, the program will address the importance, use and role of "essential qualifications/competencies" when using subjective professional and academic judgement to assess students in each of the following difficult and tough academic decision making areas:

  • Admission
  • Student performance evaluation with emphasis on clinical and training site performance
  • Individualized student evaluation and remediation
  • Probation and academic dismissal

The program will include:

  • Importance of essential qualifications
  • Need for and use of candid, critical evaluation
  • Legal principles and due process
  • FERPA and access to academic records
  • Libel and defamation
  • Discrimination
  • Disability and accommodation issues

The Presenter:

  Steve Milliam, J.D. is an affialiate assistant professor in the Department of Medical History and Medical Ethics in the University of Washington School of Medicine and is in private practice as an attorney and consultant on higher education and health law issues.  Formerly, Milam was a senior counsel and assistant attorney general serving as counsel for the University of Washington Health Sciences and Medical Centers, where his clients included the Schools of Dentistry, Medicine, Pharmacy, Public Helath and Community Medicine Nursing and Social Work, as well as Harborview Medical Center and University of Washington Medical Center.

  Milam is a past president of the Washington State Society of Healthcare Attorneys and is a past member of the board of directors of the National Association of College and University Attorneys.

  Milam has made presentations throughout the country on a variety of medical, legal, and education topics during his career.  His articles on legal issues related to the evaluation of student clinical performance and academic dismissal have been published in the New England Journal of Medicine, Academic Medicine, Journal of College and University Law, Journal of Law and Ethics in Dentistry, and Perspective on Physician Assistant Education.
